General conditions

Article 1: Definitions.

In these terms and conditions, the following definitions shall apply:

  1. vacation accommodation: (stationary) caravan, bungalow, summer house, villa, etc;
  2. lessor: the company, institution or Foundation that provides the vacation rental;
  3. Guest: the person who enters into the vacation accommodation agreement with the landlord;
  4. period of stay: period of not less than one day and not more than three months in a calendar year;
  5. connection costs: costs for connecting the vacation home to an already existing piping network;
  6. rules of conduct: rules concerning the use of and the stay at the recreation company, the place and in the vacation accommodation;
  7. complaint protocol: if a guest has a complaint, which is not resolved in consultation with the relevant landlord, the guest may report a complaint to a designated legal avenue.

Article 2: Content of agreement

  1. The landlord shall make available to the guest for recreational purposes, i.e. not for permanent residence, the agreed vacation accommodation for the agreed period of stay.
  2. The contract is concluded on the basis of the information, brochure(s) and/or other advertising material provided by the landlord to the guest.

Article 3: Soundness and safety

  1. The landlord has the right to check or have checked in the vacation home the soundness and safety of the electricity, gas and water installations present.
  2. The landlord guarantees the soundness and safety of the vacation accommodation provided, unless he can invoke force majeure or they are the result of faults in the installation for which the guest is responsible.

Article 4: Maintenance and construction

  1. The landlord shall ensure that the vacation rental is in a proper state of repair.
  2. The guest or user is not allowed – except for normal maintenance – to dig on the premises, cut down trees or trim bushes, create gardens, plant flower bulbs, or make any other arrangements of any kind near, on, under or around the vacation accommodation without the prior written consent of the lessor.

Article 5: Price and price change

  1. The agreed price includes the cost of use of gas, water, except tourist tax, cleaning and electricity costs. The residence has one electricity meter. Meter readings are taken on arrival and departure. The cost of electricity is deducted from the deposit of €500.00.

Article 6: Payment

  1. The guest must make payments in Euros, unless otherwise agreed upon, in compliance with the agreed deadlines.
  2. If the Guest, despite prior written reminder, does not fulfill his payment obligation in full, the Landlord shall be entitled to terminate the contract with immediate effect, subject to the provisions of paragraphs 3 and 4.
  3. If the landlord cancels the contract, he must inform the guest of this by registered or personally delivered letter, pointing out to him the possibility of undoing the cancellation by still fulfilling his payment obligation within 10 days from the sending or delivery of the cancellation letter, or submitting the dispute to the competent civil court.
  4. If the guest has not made use of the option referred to in paragraph 3, the landlord is entitled to deny the guest and his family members, lodgers and visitors access to his premises.

Article 8: Cancellation and early termination.

  1. The guest is entitled to cancel the agreement
  1. If the guest cancels the contract before the commencement date and the contract involves a vacation accommodation for a period shorter than one season, he shall be liable for a fixed compensation.
    • for cancellation up to 8 weeks before the start date 25% of the agreed price;
    • for cancellation up to 4 weeks before the start date 60% of the agreed price;
    • for cancellation up to 7 days before the start date, 80% of the agreed price;
    • for cancellation after 7 days before the start date 100% of the agreed price;
  1. The indemnity will be refunded proportionately after deduction of administrative costs.

The administration fee is €50.00.

  1. Landlord advises guest to purchase travel and cancellation insurance.

Article 9: Rules of conduct

  1. Guest, his family members, lodgers, visitors and any users are obliged to comply with the rules of conduct set by the lessor, including the rules regarding any required camping and accommodation documents and registration obligations.
  2. The landlord will notify the guest of the rules of conduct.
  3. Parties and celebrations organized by the guest are not allowed without prior permission from the landlord.
  4. Use of BBQ is possible and must be left clean.
  5. If the rules of conduct and/or the agreement set by the landlord are in conflict with these conditions and to the detriment of the guest, these conditions shall apply.

Article 10 : Liability

  1. The landlord is not liable for theft, damage or loss of personal belongings during the vacation rental period. Accidents in and around the vacation home or in and around the swimming pool. Temporary breakdowns of equipment in and around the vacation home. Nuisance from activities outside the leased property. Temporary disruptions in water and power supplies. Or force majeure of any kind.
  2. The guest is liable to the lessor for damages caused by the acts or omissions of himself and/or members of his family, his lodges, or visitors admitted by him, insofar as these damages are attributable to him or them.
  3. Landlord is not liable for:
  • Theft, damage or loss during the vacation rental period
  • Accidents in and around the vacation home
  • Accidents in and around the pool
  • Temporary malfunctions of equipment in and around the vacation home
  • Nuisance from activities outside the rented vacation property
  • Temporary outages in water and power supplies
  • Force majeure of any kind

Article 11: Duration and expiration of the agreement

The agreement expires automatically after the expiration of the agreed period.

Article 12: Interim termination by the landlord and eviction in the event of default

  1. If the guest, his family members, lodgers or visitors fail to comply or comply properly with the obligations of the agreement, the terms and conditions, the rules of conduct or government regulations despite prior warning, and to such an extent that by the standards of reasonableness and fairness the landlord cannot be required to continue the agreement, the landlord has the right to terminate the agreement with immediate effect. Thereafter, the

guest to vacate the vacation property and leave the premises as soon as possible. The warning may be omitted in very urgent cases.

  1. If the guest fails to vacate their vacation rental, the landlord is entitled to vacate the vacation rental at the guest’s expense.
  2. If the guest believes that the landlord has wrongly terminated the contract, he should immediately notify the landlord.
  3. In principle, the guest remains obliged to pay the agreed rate.

Article 13: Dissolution

  1. If the rented vacation accommodation has become void or temporarily unusable through no fault of the landlord, the landlord and the guest have the right to cancel the contract. If the destruction of the vacation property or the temporary disuse of the vacation property to the landlord is attributable, the guest may claim damages.
  2. If possible, the landlord may provide the guest with an equivalent replacement vacation rental at an equal offer price. In that case, the guest can choose between dissolution or accepting the replacement vacation home.

Article 14: Use by third parties

Neither the landlord nor the guest is permitted to assign the vacation accommodation under any designation to anyone other than the persons named in the contract, unless expressly agreed otherwise. The conditions under which the permitted commissioning takes place shall be arranged in advance by separate agreement.

Article 15: Changes

Changes to the UwBoeking.com terms and conditions may be made only by the management of UwBoeking.com. This means that the guest and the landlord can make individual additional arrangements in which deviation from these terms for the benefit of the guest.
